Data Privacy Notice for Candidates

The protection of your privacy is of utmost importance to us. We shall receive data from you in the course of your application process with us. We shall collect and use your data for our own purposes in accordance with the General Data Protection Regulation (GDPR). 

Below we provide you, as the data subject within the meaning of data protection law, with the information prescribed under Articles 13 and 14 GDPR with regard to the collection of personal data:

2. Processing Framework

a) Purpose of the data processing, legal basis

We shall process your personal data for the purpose of carrying out the application procedure, insofar as this is necessary. If you apply directly via our website, we shall use the services of Lever Inc., 1125 Mission Street, San Francisco, CA 94103 (hereinafter "Lever") for carrying out the application procedure.

You can also email your application to us at talent@justwatch.com. However, we are obliged to point out that email is not a secure way of sending personal data. You are, of course, also always free to send your application by mail.

The data processing takes place on the legal basis of Article 88 GDPR in conjunction with Section 26 BDSG [German Federal Data Protection Act] (data processing in an employment context for the purpose of hiring). The processing of special categories of personal data (e.g. health data) takes place on the basis of Article 9 GDPR only insofar as you have expressly consented to one or more specified purposes, or insofar as this is necessary for exercising rights or performing duties arising from employment law, social security law or social protection law.

If you have consented to your personal data being stored in our talent pool, the processing will take place on the basis of your consent in accordance with Article 6 (1) a) GDPR. You can revoke your consent at any time with effect for the future by either configuring the corresponding setting in your profile with Lever under the tab "Your Data" or emailing us at privacy@justwatch.com

b) Categories of personal data processed

We shall process the following categories of your data: name, address, other contact details, LinkedIn profile, date of birth, education, work experience, results of the personnel selection procedure and comparable data.

c) Source of personal data

As a rule, your personal data will be collected from you yourself, except where these data are communicated to us by another entity, in particular by public authorities or – where you give us the names of third parties as references – by these third parties.

d) Duration of data storage

As a rule, we shall store your personal data for the duration of the application procedure, as well as for a further 6 months thereafter. In individual cases, individual data may be stored for a longer period, e.g. for the purpose of settling travel expenses. If your application leads to you being employed with us, your application data will then continue to be stored and processed for the purpose of establishing, carrying out and discontinuing the employment. In this case, you will be separately informed of this change of purpose. 

If you have given us your consent to storing your personal data beyond the application procedure in order to inform you of new job offers, we shall store your data for a period of 12 months, or until you revoke your consent.

3. Sharing of Data, Reference to Foreign Countries

The following categories of recipients may receive your personal data at JustWatch: the colleagues from talent and recruiting, your line manager, the CEOs and our legal counsel.

If you apply directly through our website, we shall share your data with Lever. In this respect, your data will be sent to the United States of America (USA) and stored there. To protect your personal data, we have concluded so-called Standard Contractual Clauses ("SCC"). Additionally, we have checked Lever's technical and organisational measures in order to ensure that Lever meets its obligations arising from the data processing agreement and the SCC, and that your data will also be optimally protected in the USA.

4. Rights of Data Subjects

Under the GDPR, you are entitled to the following statutory rights as the data subject insofar as the prerequisites for these rights are met:

  • right to access your data stored with us, in accordance with Article 15 GDPR,

  • right to rectification of incorrect data, in accordance with Article 16 GDPR,

  • right to erasure of the data stored with us, in accordance with Article 17 GDPR,

  • right to restriction of processing of the data stored with us, in accordance with Article 18 GDPR,

  • right to data portability in accordance with Article 20 GDPR,

  • right to withdraw at any time, in accordance with Article 7 (3) GDPR, any consent you may have given us; this will have the consequence that we shall no longer be permitted to continue the data processing in future on the basis of this consent;

  • right to lodge a complaint with the competent supervisory authority in accordance with Article 77 GDPR if you are of the opinion that the processing of the personal data concerning you breaches provisions of the GDPR.

Right to object

Where your personal data are processed on the basis of legitimate interests in accordance with Article 6 (1), sentence 1, f) GDPR, you have the right under Article 21 GDPR to object to the processing of your personal data insofar as there are grounds for doing so relating to your particular situation.

You can make use of your right to object at any time, but also obtain access to your data or obtain rectification or erasure thereof, by configuring the corresponding setting in your profile with Lever under the tab "Your Data" or by emailing us at privacy@justwatch.com
